Welcome to Message24. These Terms of Use ("Terms") govern your access to and use of the Message24 platform and services. By accessing or using Message24, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our service.

1. Description of Service

Message24 is a multi-platform messaging service that enables businesses to manage customer conversations across various social media platforms from a unified interface. Our service allows you to connect your business accounts from platforms including Facebook, Instagram, TikTok, and WhatsApp to send, receive, and manage messages with your customers.

2. Account Registration

To use Message24, you must:

  • Be at least 18 years old or the age of majority in your jurisdiction
  • Register for an account using valid credentials
  • Provide accurate and complete information during registration
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access to your account

You are responsible for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our sole discretion.

3. User Content

"User Content" refers to any messages, images, videos, documents, or other materials you create, upload, or transmit through Message24.

  • Ownership: You retain ownership of your User Content. However, by using our service, you grant Message24 a worldwide, non-exclusive, royalty-free license to use, store, process, and transmit your User Content solely for the purpose of providing and improving our service.
  • Responsibility: You are solely responsible for your User Content and the consequences of posting or transmitting it. You represent that you have all necessary rights to the content you share.
  • No Illegal Content: You agree not to upload or transmit content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.

4. Third-Party Integrations

Message24 integrates with third-party platforms including but not limited to Facebook, Instagram, TikTok, and WhatsApp. By connecting these platforms:

  • You agree to comply with each platform's terms of service and policies
  • You authorize Message24 to access and use your account data from these platforms as necessary to provide our service
  • You understand that Message24 is not responsible for the availability, accuracy, or functionality of third-party platforms
  • You acknowledge that changes to third-party platform policies may affect Message24's functionality

5. Acceptable Use

You agree not to use Message24 to:

  • Send spam, unsolicited messages, or bulk commercial communications
  • Engage in harassment, abuse, or threatening behavior
  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of others
  • Transmit malware, viruses, or other harmful code
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with or disrupt the integrity or performance of our service
  • Collect or harvest data from our service without authorization
  • Impersonate any person or entity
  • Engage in any activity that violates the terms of connected third-party platforms

6. Intellectual Property

Message24 and its original content, features, and functionality are owned by Message24 and are protected by international copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

You retain all rights to your User Content. These Terms do not grant us any rights to your content beyond what is necessary to provide the service.

7. Disclaimers

MESSAGE24 IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the service will be uninterrupted, secure, or error-free. We do not guarantee the accuracy, completeness, or usefulness of any information provided through the service.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MESSAGE24, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability to you for any claims arising from or related to these Terms or your use of the service shall not exceed the total amount of fees paid by you to Message24 during the twelve (12) months preceding the claim.

9. Indemnification

You agree to defend, indemnify, and hold harmless Message24 and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from: (a) your use of the service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property rights; or (d) your User Content.

10. Termination

Either party may terminate this agreement at any time for any reason.

  • By You: You may stop using the service and request account deletion at any time by contacting us.
  • By Us: We may suspend or terminate your access to the service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the service will cease immediately. We may retain certain information as required by law or for legitimate business purposes.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Your continued use of the service after any changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Kurdistan Region of Iraq, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the service shall be subject to the exclusive jurisdiction of the courts located in Erbil, Kurdistan Region of Iraq.
